WEBSITE SHOP TERMS AND CONDITIONS

Topline Sports does not currently offer a payment method on its website shop. Once you process your cart, Topline Sports will send you an official, no obligation, quotation on the items in the cart. You can decide to do a payment for those items if you so desire.

While every effort is taken to keep the content of the shop, including, but not limited to, the prices, up to date, Topline Sports reserves the right to change the price in the official quotation that will be send to the user. The user will be under no obligation to accept the quotation, whether the prices on the quotation changed from those on the website, or not.

As erroneous information and/or prices may be displayed on this Website from time to time, you agree that Topline Sports cannot be held liable for any inaccurate information and/or prices published on the Website.

Prices on our website is not applicable to instore purchases.

Products purchased by means of sending a quotation request thru the checkout procedure of the online shop, may be collect from our store at 49 Mooi Street Welkom or, if required, can be couriered to the client. All courier costs will be for the client’s account.

The advertising of products via the Website merely constitutes an invitation by Topline Sports for you to make an offer to purchase products and we remain entitled to reject any order without giving reasons therefore and without any liability to you.

Although the Website is set up to forward quotation requests automatically to Topline Sports, technical or other problems may delay or prevent such transmissions. Please contact Topline Sports if you have not received a response from us in two working days.

Placing products in a wish list or shopping basket (cart) without completing the cycle does not constitute an order for such products, and as such, products may be removed from the shopping basket (cart) if stock is no longer available, or the price thereof might change without notice to you. You cannot hold Topline Sports liable if such products are not available or are not available at the particular price when you complete or attempt to complete the cycle at a later stage.

You acknowledge that stock of all products on offer is limited and accept that the display of products is not necessarily a guarantee that a product is available.

One of the external links on the online shop is to the https://toplinesports.bcgshop.co.za/ website. This site is administered by an external party and although you can browse and see prices, Topline Sports has extremely limited control over what you see as well as the prices displayed on these pages. For this reason, the prices shown servers only as an indication and by visiting these pages you agree that Topline Sports may hange the prices on the official quotation that will be send to you.

 

REFUNDS and EXCHANGE POLICY

If you are dissatisfied with an item purchased from our store you may return it to Topline Sports for a refund, replacement or exchange provided that the conditions of our Refund & Exchange policy have been satisfied.

          The original till slip is required.

          All refunds are processed strictly in accordance with the original sales tender type.

          Returned products must be in the original condition and in undamaged packaging.

          Refunds or Exchanges will only be applicable for fourteen days after purchase.

          For hygiene reasons swimwear and underwear may not be returned or exchanged.

          We will only consider exchanging or refunding a faulty product if it was used for its intended purpose and in accordance with the product’s instructions and / or user manual.

          No refunds or exchanges will be made for a product that has been misused or purposely damaged.

          A faulty product will, where relevant, be subject to a technical assessment by a specialist before being repaired, replaced, or refunded.

          Repairs may involve a courier cost that is for the customer’s account and will be quoted upfront.

          All items to be considered for a refund or exchange, must be returned to Topline Sports at 49 Mooi Street, Welkom. Any cost that my be applicable to return the item(s) to Topline Sports, will be for the customers account.

 

EMBROIDERY TERMS AND CONDITIONS

By accepting the job card, you are bound by these terms and conditions.

Please note that, while every care is taken with your goods, embroidery is a mechanical process with a very small chance of damage occurring to items. The client therefore understands, and agrees, that all embroidery of goods is undertaken entirely at the customer’s own risk. Neither Topline Sports nor any person\entity employed\contracted by or connected with Topline Sports will be liable for damages of any kind.

The client acknowledge that they have obtained all proper permissions/licensing for the use of any logo, pattern or design protected by copyrights, patents, trademarks or other intellectual property rights and that the client shall indemnify, and hereby agree to hold Topline Sports, including any person\entity employed\contracted by or connected with Topline Sports, harmless against all loss, expenses, damages, costs and legal fees by reason of any actions based on the infringement thereof.

The client understand that it is their responsibility to proof the digitized design prior to production.

The client understands, and agrees to the fact, that the digitized file is the sole property of Topline Sport, or any entity that may have been contracted by Topline Sports to do the digitizing on its behalf, and that the client has no right to said file.

The client understand that embroidery is achieved by looping thread through fabric to create textured blocks of colour and that detail on images/writing might be lost due to this.

By signing the Job Card, the client accepts the Job Card in full and exactly as is. The client understands that Topline Sports will make every reasonable effort for timely delivery but that Topline Sports does not assume responsibility for any delays.

All goods left at owners’ own risk. Goods not collected within 30 days after the Completion Date, will be sold to cover costs.

No refunds will be allowed for embroidery as it is permanent and cannot be undone.

 

PRINTING TERMS AND CONDITIONS

By accepting the job card, you are bound by these terms and conditions.

Job Cards must be paid in full before Topline Sports will begin with it.

All artwork files must be in JPG or PNG format. The artwork itself must be a line drawing and must not be less than 300 DPI. Printing can only be as good as the artwork. Topline Sports will not be responsible for poor quality printing due to poor quality artwork or fabric type.

Please ensure that all spelling is correct on the Job Card before signing it. Topline Sports will not be responsible for any mistakes after the Job Card has been signed.

The client understands that Topline Sports will make every reasonable effort for timely delivery but that Topline Sports does not assume responsibility for any delays.

No refunds will be allowed for printing as it is permanent and cannot be undone.

 

WORKSHOP TERMS AND CONDITIONS

By accepting the job card, you are bound by these terms and conditions.

Job Cards must be paid in full before Topline Sports will begin with it.

All items are left at Topline Sports on the client’s responsibility and Topline Sports cannot be held liable for any los or damages whatsoever.

The client understands that the knocking in of cricket bats is done to compress the wood fibres and that dents and surface cracks will almost certainly appear during this process. The client understands that this is a normal part of the knocking in process and will not hold Topline Sports responsible for this. The client also understands that cricket bats of lesser quality wood will have more, larder. deeper indents and surface cracks.

The client also indemnifies Topline Sports of any damage that any cricket bat, that was knocked in by Topline Sports, might incur after it has left the premises of Topline Sports and that knocking in the bat does not guarantee that the bat will not crack, break, splinter or get damaged in any way whatsoever.

The client understands that Topline Sports will make every reasonable effort for timely delivery but that Topline Sports does not assume responsibility for any delays.

 

QUOTATION TERMS AND CONDITIONS

These Terms and Conditions apply to all quotations issued by Topline Sports.

          By accepting a quotation, you are bound by these terms and conditions.

          The quotation is only valid for 14 calendar days. An updated quotation may be requested after it has expired.

          Some items may not be in stock and may need to be ordered from our suppliers.

          All items subject to availability from suppliers.

          All lead times subject to suppliers lead times plus the freight times required.

          Quotation excludes transport costs.

          All quotations are subject to E&OE

          Topline Sports will only start processing any accepted quotations once the full quotation amount plus any relevant transport costs are payed in full. All EFT must firs reflect in Topline Sports bank account before we can start processing the quotation and at least 3 working days (Monday to Friday) will serve as lead time for such an EFT to reflect.

          To avoid delays in allocating your payment, please ensure that you indicate the correct reference, as indicated on the quotation, in the reference field of your EFT.

          It is the sole responsibility of the client to ensure that Topline Sports have received any payments.

          It is the sole responsibility of the client to inform Topline Sports that they are accepting the quotation.

          All accepted quotations must be signed by the client and returned to Topline Sports.

          Topline Sports reserves the right to pass on any bank fees incurred as a result of cash or cheque deposits made by the client. Electronic Fund Transfers directly into our bank account or Cash / Visa / Mastercard payments in our store will not carry any penalties.

          A signed quotation, or purchase order placed against this quotation, is deemed to be, and shall constitute, acceptance of this quote and these terms.

          Cancellation of an order can be made only with Topline Sport’s consent and upon terms that will compensate Topline Sports against loss.

          This quotation is not to be construed as an obligation to sell and no contractual relationship shall arise from it until the Customer’s order has been accepted by Topline Sports.

          Topline Sports shall not be bound by any condition attaching to the Customer’s order or acceptance of a Quotation and, unless such conditions are expressly accepted by Topline Sports in writing, the Customer acknowledges that such conditions are expressly negated.

          Any service or advice which may be offered by Topline Sports, its contractors, or agents, to the Customer or its agents, is rendered in good faith and Topline Sports shall not be liable for any loss or damage arising therefrom.

          It is the sole responsibility of the Customer to ensure that the quoted items are correct and that it is suitable for, and adheres to, the Customers’ needs and requirements.

          The Quotation document / file is confidential and issued for the information of the addressee only.  It is subject to copyright and may not be reproduced in whole or in part without the written permission of Topline Sports.

          Under no circumstances shall Topline Sports be liable to the Customer, or any other person or entity, for any loss of use, revenue or profit, loss or damage, or other commercial or economic loss or for any other indirect, incidental, special, punitive, exemplary or consequential damages whatsoever, even if advised of the possibility of such damage or if such damages are foreseeable. This limitation shall apply even in the event of a fundamental breach or a breach of the fundamental terms hereof. The Customer agrees that Topline Sport’s suppliers shall have no liability of any kind under, or as a result of, this Quotation and/or its conclusion.

          The client understands and accepts that Topline Sports will make every reasonable effort for timely delivery but that Topline Sports does not assume responsibility for any delays or the availability of items.

 

TOPLINE SPORTS CLUB CARD LOYALTY PROGRAMME TERMS AND CONDITIONS

In order to promote its brand, as well as the products sold by it, Topline Sports has set up a rewards programme.

These Membership Terms may be updated by Topline Sports from time to time without notice. Please visit www.toplinesports.co.za for the latest version of these Membership Terms.

          Topline Sports reserves the right to cancel or discontinue the Topline Sports Club Card Rewards at any time for any reason whatsoever.

          You must be 18 years or older to become a member.

          Neither membership, nor points may be transferred.

          You must complete an entry form to apply for membership. All required fields must be completed. A valid cell phone number and email address must be provided.

          Membership is free of charge.

          Your memberships start when your details have been captured on our system.

          Membership might expire if the last invoice on your account was more than 12 months ago.

          When a membership expires, all points and deposits will be forfeited.

          Points expire after 12 months.

          Any possible deposits will be forfeited after 120 days.

          New points earned will be loaded at the beginning of every month.

          By becoming a member, you give Topline Sports permission to send you promotional material.

          Points can only be used as a discount on purchases at Topline Sports and cannot be converted into cash.

          Points amounts may include points earned and/or possible deposits that on your account.

          Points can be earned as a percentage of your purchases during a period.

          A minimum amount of R100.00 (one hundred rand) must be purchased on your Club Card account, in a calendar month, to qualify for any Club Card points in that calendar month.

          It is the customers sole responsibility to ensure that transactions are done on their Club Card number and this can be verified on the till slip by ensuring that their details (name) is displayed at the bottom of the slip.

          No credit facilities will be provided on these Club Card accounts.
